Why will the prosecution of Peter Hain not go ahead?

You choose why the prosecution of Peter Hain will not go ahead?

a) "a prosecution would not be in the public interest"

b) "insufficient evidence to prosecute"

It will be one or the other because for some peculiar reason Labour government ministers never seem to get prosecuted, strange that...

On a related matter, once cleared how long before he is brought back into government - not because Gordon Brown wants or needs him back, but just to show us who are the masters and who are the subjects now?
