I am familiar with US prosecuting authorities practice of twisting the meaning of statute to get a conviction (witness the 4 Merrill Lynch bankers in the Enron Nigerian barges case who were convicted but later freed on appeal on the basis that the acts for which they were convicted didn't actuallyt contravene any statutes!), but I don't see how Mrs Clinton has actually contravened this statute by using a private e-mail, even if she did transmit confidential information. She did not destroy or conceal any official documents. That isn't to say she may well be guilty under some other provision.
